Since 29 May 1998, the Commissioner of Customs and Excise has begun to administer a licensing scheme on the local manufacture of optical discs under the Prevention of Copyright Piracy Ordinance (Cap. 544).

According to section 3 of the Ordinance, no person shall manufacture pre-recorded or blank optical discs in Hong Kong unless he holds a valid licence. Section 4 also stipulates that no licensee shall manufacture optical discs in any place in Hong Kong other than a licensed premises.

Apart from fulfilling the registration requirement under the Ordinance, an optical disc manufacturer is also required to mark on the read-through side of every disc with a manufacturer's code assigned by the Commissioner to indicate its source of production. The code must be etched, engraved or otherwise indelibly marked in such manner that the manufacturer's code is legible upon a visual examination of the optical disc.

Application
 

An applicant should complete CED Form 361 to apply for a licence for the manufacture of optical discs. The Form can be obtained free of charge from the following office -

Hong Kong.

 

Submission of Applications
 

The completed Form should be submitted in person or by registered post to the Optical Disc Licence Division at Room 1035, 10/F, Skyline Tower, 39 Wang Kwong Road, Kowloon Bay, Hong Kong.

Processing Applications and Factory Inspection
 

After you have submitted your application form with all necessary supporting documents to the Optical Disc Licence Division, we will contact you within one week for making an appointment for inspection of manufacturing premises. Under normal circumstances, you will be informed of the result within 14 working days from the date you submit the application. The licence fee shall not be paid until the application has been approved. You will be notified for collection of the approved licence once it is available.

 

Licence fee
 
The licence fee is HK$5,500, covering a period not exceeding 3 years. The licence is valid on the date of payment.
